Privacy Policy - for Movers
The term 'us' or 'we' refers to the owner of The Movers Logistics and Technology Services Pty
Ltd (also referred to as The Movers), a private limited company, founded and registered in the
Republic of South Africa.
The term 'Mover/Customer or you' refers to an individual or a business that uses The Movers
Services to request moving services to get their various items moved and delivered.
The term 'Moving Partner/Driver' refers to any individual or a business who has partnered with
us to provide moving services to Movers who request for a move using The Movers Services.
The term 'The Movers Services' refers to The Movers mobile application, The Movers Platform and
other services we offer using various channels provided by The Movers Logistics and Technology
Services Pty Ltd trading as The Movers.
The term 'The Movers Mobile Application' refers to a service rendered through a mobile
technology and platform to help and facilitate moves amongst Movers, Moving Partners and other
authorised third parties.
The term 'The Movers Platform' refers to the platform provided to connect Customers to various
Moving Partners to help them move and deliver their various items.
The term 'Charge' refers to a fee the Customer is obligated to pay The Movers providing Moving
Services.
The term 'Service Provider Fee' refers to the fee the we have derived for providing the Moving
Services and to maintain them as well.
The term 'Scheduled Moved' refers to a move that has been scheduled by the Customers using The
Movers Platform.
The term 'Agreement' refers to a contractual agreement between You and The Movers Logistics and
Technology Services. Pty Ltd.
The term 'Loader and Unloader' refers to an individual who is a moving partner who specifically
helps with loading and unloading and also packing services where applicable.
The Movers App is a mobile technology platform used to connect Movers and Moving Partners to
exchange Moving Services. The Moving Partners provide the Moving Services on an independent
basis, we provide a technology platform to connect you and the Moving Partners.
Disputes arising from consumer rights, legal obligations, or from the law applicable to the
provision of Moving Services will be resolved between the Mover and Moving Partner.
Data regarding the Moving Partners and their moving service is available in The Movers' servers
and receipts for journeys are available through The Movers app. You will receive communication
via email and/or sms in the near future.
The Mover (you) agrees with the Moving Partner for the provision of the Moving Services booked
on The Movers App, the payment method accepted is via The Movers App and Ozow Pty Ltd, moving
fees will be inclusive of applicable taxes where required by law. Moving fees may include other
applicable fees, and/or surcharges including, municipal tolls, airport surcharges, or processing
fees for split payments.
During user sign-up of The Movers app, your mobile number, and email address is linked to the
respective user’s account and added to our server. If you are no longer using your contact
details you can update it by contacting us.
You are logged in or signed up and your details are stored for processinig by us when you book a
move.
It is your responsibility to ensure that your account is safe when logged into The Movers
Platform.
2. The Movers In-App Payment
We accept payment via Ozow Pty Ltd, when booking a move, you will be prompted to follow the Ozow
Pty Ltd payment flow to complete booking a move, it is your responsibility to ensure that the
payment takes place and ensuring that sufficient funds are available in your bank account.
Payment for the Moving Services will be made on the app before the move begins, you can cancel
the move and refund will happen at our discretion.
We are responsible for the functioning of the in-app payment and provide support in resolving
problems, the resolution of the disputes related to The Movers in-app payment also takes place
through us. For payment support please contact info@themoversworldwide.net. Inquiries submitted
via email will get a response within 24 hours.
3. License to Use The Movers App
The Movers grants you a license to use the app and it does not grant you the rights to
sublicense or transfer data to the third party.
While Using The Movers User's Account, You May Not
• You may not modify The Movers App in any manner or form.
• You may not transmit files that contain viruses, corrupted files, or any other programs that
may compromise the operations of The Movers.
• You may not try to gain unauthorized access to The Movers App once your account has been
terminated.
• The license granted herein revokes automatically and simultaneously with the termination of
the agreement. After the termination of the agreement, you must immediately stop using The Movers
App. We are entitled to block and delete your User’s Account without prior notice.
• All copyrights and trademarks, including source code, databases, logos, and visual designs
are owned by The Movers Logistics and Technology Services Pty Ltd and protected by copyright and
trademark, By using The Movers Platform, The Movers App, you do not acquire any rights of ownership
to any intellectual property, this prohibits you from modifying, updating or editing, deleting the
source code.
4. Liability
The Movers app does not offer or broker moving services for movers, it is used as a technology
platform to connect You and Moving Partners and offer Moving Services.
The consumer's rights of refund are not applied to The Movers App moves, requesting a refund for the
moving service does not withdraw you from the agreement in the course of which the provision of the
moving services was scheduled.
The Movers app is provided on an “as is” and “as available “, we don’t guarantee that access to The
Movers app will be uninterrupted or error-free, in case of any error in the software, we will work
on correcting them as soon as possible, please keep in mind that the functioning of the app may be
limited due to occasional errors and we are not able to guarantee that the app will function at all
times, in cases such as a public emergency.
You can book anytime and pay later. However, you have to pay no later than the day you chose to move
or rent a vehicle. Failure to do so may result in penalty fees of a minimum of R1500 per day, for
the attempt to retrieve the funds from you which you could have easily paid. In addition, you will
be liable for all lawyer fees incurred due to your misconduct of not paying for a move on time.
We are not liable for any loss or damage that you may incur as a result of using The Movers app and
services, including and not limited to:
You are liable for any lawyer fees incurred by us due to your misconduct. Misconduct is
distinguished at our discretion.
1. Any accidental or non-accidental damage to your property or monetary loss.
2. Loss of profit, money, businesses, contacts, reputation, and any loss that may occur from
interruption of the business.
3. Any other type of loss or damage.
• We are liable in connection to the breach of the contract that we deliberately violated, we
are not liable for the action or inactions of the Moving Partner(s) and will not be liable for
damage that the Moving Partner causes to the mover(you).
• You agree to fully indemnify and hold The Movers, representatives, employees, and directors
harmless from any loss claim or losses (including liabilities, damages, costs, and any expenses of
any nature) that you have suffered as a result of your use of The Movers app, we may immediately
terminate your use of The Movers App if you breach these General Terms and Conditions.
Good Practice using The Movers App
• Any issue with the quality of the moving services will be resolved by the rules and
regulations of the Moving Partner or the relevant public authority.
• We ask you to rate and give feedback about the service you have received, this enables us to
offer suggestions to the Moving Partners for improving the quality of their services.
• We expect you to behave respectfully to the moving partners who offer their moving services
through The Movers app and use of The Movers app and services in good faith. We retain the right to
close down your account if you have violated the General Terms and Conditions or if you have acted
maliciously toward the Moving Partners i.e. withholding payment for the provision of the moving
service, fraud, being disrespectful towards the moving partner, specifying deceitful information in
the app, etc.
• We will make every effort to ensure that only moving partners who operate on honesty and
integrity and are respectful to our movers, use The Movers app. However, we are in no position to
guarantee that every moving partner satisfies the aforementioned criteria at all times. If you
experience objectionable moving service please notify us immediately.
• When specifying that you have a lift/elevator in your building, you must ensure that you
know that it works or else fees will apply for no provision of the lift/elevator in the building
specified in the request for the move.
5. Amendments to the Terms of Use
• If any changes are made to the General Terms and Conditions, then you will be notified by
email or The Movers push notifications, the continuation of using The Movers app, you will be deemed
to accept the amendments.
6. Applicable Law
The General Terms and Conditions and Agreement shall be governed by and construed and enforced by
the laws of the Republic of South Africa. If the respective dispute resulting from General Terms or
Agreement could not be settled by negotiations, then the dispute shall be solved in any court of law
in the Republic of South Africa.
Privacy Policy
1. Privacy Policy for Movers
The Movers Logistics and Technology Services Pty Ltd (K2020751617) trading as The Movers is located
at The Woodlands Office Park, 20 Woodlands Road, Woodlands, Sandton, 2080, Gauteng, South Africa, is
the controller of personal data of all users of our services through all channels.
2. The Personal Data We Process
We collect your name, e-mail, geolocation, phone number, payment details, pictures, and details of
the move. The Movers will also collect information from your computer, phone, tablet, or other
devices you are using to access our platforms and The Movers app. This includes the IP address, the
browser you use, and your language settings. we may collect your precise or approximate location
information as determined through data such as your mobile network, GPS, IP address, and WiFi.
Insomuch as the local laws might contradict the privacy policies of Facebook, Instagram, Messenger,
and other products and features offered by Facebook (collectively “Facebook”), then the Facebook
policies shall prevail.
3. Purpose of Processing Data
We collect and process personal data for the purpose of connecting Customers who would like to move
with Moving Partners with the capability to help them move around cities more efficiently.
Geolocation and driving routes are processed to analyse the geographical area and give suggestions
to the Moving Partners. If you do not want to disclose your geolocation for The Movers App, you must
update your status to offline.
The protection of your personal information or data that we collect, process and apply during your
use or visit to any of our various platforms and The Movers App is important to us. Your data is
protected in accordance with the provision of locals data protection and privacy policy law.
The Movers will send you the moving partner's name, and details of the vehicle for the Moving
Service including photos of the vehicle, where applicable.
By signing up as a mover, you consent The Movers ® to marketing by default. You are presented with options to delete your account and opt out using any of our platforms and communication channels.
4. Legal Basis
Personal data may be processed on the ground of legitimate interest in investigating and detecting
fraudulent payments. Data regarding criminal convictions and offenses is processed for compliance
with a legal obligation.
5. Recipients
Your relevant data will be sent to the Moving Partner, who has accepted your request for a move. The
Moving Partner will see your name, surname, phone number, email address, phone number, details of
the move, and geolocation data to fulfil your request.
6. Security and Access
Any personal data collected in the course of providing Moving Services is transferred to and stored
in the data centers of Google LLC (formerly known as Google Inc.), which are located in the United
States of America. Only authorized employees and service providers of The Movers Logistics and
Technology Services Pty Ltd will have access to the personal data and they may access the data for
the purpose of resolving issues associated with the use of the services (including disputes
regarding moving services).
We cannot guarantee that your information will not be accessed, disclosed, altered, or destroyed by
breach of any of our physical, technical, or managerial safeguards. If we learn of such a breach, we
will attempt to notify you electronically so that you can take appropriate protective steps. We also
reserve the right to post a general notice on The Movers platforms if a security breach occurs.
The Movers Group companies and partners can access personal data to the extent necessary to provide
customer support in the respective country.
